Is Possessing Marijuana Paraphernalia Legal in New Jersey?

shutterstock_1160627104

New Jersey is one of many states that has taken significant steps towards legalizing recreational marijuana use in recent years. Due to new legislation, weed has been effectively decriminalized in the Garden State. With all of these new laws being put into place, it’s important to understand what is legal, and what is against the law. If you are concerned about the legality of carrying around marijuana paraphernalia, you should familiarize yourself with the new decriminalization laws passed recently.

If you have been charged with any crime related to marijuana possession, it’s important to enlist the help of a qualified, experienced attorney as soon as possible. While New Jersey’s new laws offer a much greater degree of protection to marijuana users, you still have to defend yourself in a professional manner. An experienced New Jersey criminal defense attorney can help you avoid unnecessary jail sentences and fines. Although you may enjoy many new freedoms in New Jersey, you still need to fight for your rights effectively.

New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act

Otherwise known as NJ S21, the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act was signed during the 2020-2021 Regular Session. The bill essentially decriminalizes recreational marijuana use. This only pertains to legal cannabis, and individuals under the age of 21 are not included in this law. There are also limitations on how much marijuana you can legally possess, and those who possess more than one ounce will face penalties.

Is it Legal to Possess Paraphernalia?

Yes, marijuana paraphernalia is included in the bill. It is legal to “possess, purchase, or transport cannabis paraphernalia.” This means that you will not face any legal consequences if you are caught with pipes, bongs, rolling papers, grinders, or anything of that nature.

Be Careful When Driving With Weed

The new bill also clearly states that you can “transport” these items, which means that you can drive with less than an ounce of marijuana. You can also drive with your marijuana paraphernalia in the vehicle. Passengers can even consume marijuana products that do not involve smoking or vaporizing, such as edibles.

That being said, you need to be very careful when driving with marijuana and marijuana paraphernalia. It is a motor vehicle offense for a motor vehicle operator to possess an “open container” or “open package” of marijuana. The consequences of this offense are similar to those involving driving with an open alcoholic beverage.
