What Is The Penalty For Stealing Sunglasses In New Jersey?

Sunglasses

According to various studies, even generic, run-of-the-mill sunglasses can provide profit margins of over 100 percent. Some designer shades cost many thousands of dollars – representing a clear target for shoplifters in New Jersey who want to grab small, valuable items. What shoplifters might not realize, however, is that penalties become increasingly more severe with a higher total value of stolen goods. What happens if you are caught stealing sunglasses in New York? What kind of penalties might you face?

Defendant Accused of Stealing More than $13,000 in Sunglasses

On December 1st of 2023, it was reported that a defendant had been charged with shoplifting in New Jersey. The individual in question was arrested at the Short Hills Mall, having been discovered with no less than $13,000 worth of stolen sunglasses. The sunglasses in question were all of the Cartier variety, and he only had five pairs in his possession. In other words, each pair of sunglasses had a value of about $2,600. These shades were apparently taken from the Eyechic store at the mall.

The defendant was charged with shoplifting after being taken into custody by the police. There was no word on the specific degree of shoplifting charge that he faced. However, the high market value of the stolen goods will almost certainly lead to the possibility of serious penalties.

Why Expensive Sunglasses Can Lead to Serious Shoplifting Charges

The theft of expensive sunglasses can lead to serious shoplifting penalties because of the way this offense is prosecuted in New Jersey. Those who steal items with high market values will face tougher penalties compared to those who steal low-priced items. Note that the courts will only consider the “retail value” of the stolen goods and not the actual value. This is especially relevant in the context of sunglasses, as the actual value of these items is negligible. The average pair of sunglasses costs only $20 to make. With the addition of a Cartier logo, however, the value skyrockets for a retail price of over $2,500.

Even if a defendant steals a single pair of designer sunglasses, they may face Shoplifting in the 3rd Degree. As long as the retail value of the stolen items is more than $500, the defendant may face up to five years in prison and a fine of up to $15,000. The minimum sentence for a crime in the third degree is three years imprisonment.
